The first generation of  Vietnamese lawyers

 Vietnamese Lawyer means a person who satisfies all the standards and conditions to practise in accordance with the provisions of Law on lawyers of Vietnam, and who provides legal services at the request of clients, includes:

1. Standards for Vietnamese lawyers
  A Vietnamese citizen who is loyal to the Fatherland, who complies with the constitution and laws, is of good morals, has a bachelor”s degree in law, has completed a legal professional training course and the probation period for legal practice, and is in good health sufficient to practise law, may become a Vietnamese lawyer.

2. Conditions for practising law inVietnam
  Any person who satisfies the standards stipulated in Point 1 mentioned above and who wishes to practise law must have a legal practising certificate and be admitted to a bar association in Vietnam.

3. Legal services of Vietnamese lawyers

 Legal services of Vietnamese lawyers shall include
  a. Pparticipation in legal proceedings,
  b. Legal consultancy,
  c. Representation of clients other than in legal proceedings
  d.  Provision of other legal services.

4. Rights and obligations of Vietnamese lawyers

4.1. Vietnamese lawyers have the following rights:

  a. To be entitled to protection by law of the right to practise law in accordance with Law on lawyers and provisions of relevant laws;
  b. To represent clients in accordance with law;
  c. To practise law, and to select a form of legal practice and a form of legal practising organization in accordance with Law on lawyers;
  d. To practise law throughout the entire territory of Vietnam;
  e. To practise law overseas;
  f. Other rights stipulated in Law on lawyers.

 4. 2. Vietnamese lawyers have the following obligations:

  a. To comply with the principles on legal practice as stipulated in article 5 of Law on lawyers;
  b. To strictly abide by internal rules and relevant provisions in the relationship with the bodies conducting legal proceedings; to co-operate with and respect any person conducting legal proceedings whom the lawyer meets during legal practice;
  c. To participate in legal proceedings fully and promptly in cases at the request of the body conducting such proceedings;
  d. To provide legal aid;
  e. To participate in compulsory professional and technical training;
  f. Other obligations stipulated in Law on lawyers.

5. Principles on legal practice of Vietnamese lawyers

  a. Compliance with the constitution and laws.
  b. Compliance with the Rules on Professional Ethics and Behaviour of Vietnamese lawyers.
  c. Independence, honesty and respect for the objective truth.
  d. Use of lawful means to properly protect the lawful rights and interests of clients.
  e. Legal liability for professional activities
