Handbook of Decree 219/2025/ND-CP on foreign labour in Vietnam
The handbook of Decree 219/2025/ND-CP replacing 152/2020/ND-CP and 70/2023/ND-CP has many important new points regarding foreign labour in Vietnam, including: integrated administrative procedures and shortened processing time, decentralization of licensing authority to the Provincial People”s Committee, expansion and clarification of cases exempted from work permits, clear regulations on permitted job positions, permission to work in multiple localities when licensed in one province, and increased procedural connectivity through the National Public Service Portal.
The Handbook of Decree 219/2025/ND-CP shows the following main new points:
1. Integrating procedures and shortening processing time to 10 working days (Clause 3, Article 22 of Decree 219/2025/ND-CP):
• Previously, the procedures for approval on demand for foreign labour and granting a Work Permit were two independent processes. Now, company can submit the application for approval on demand for foreign labor at the same time as the application for granting/renewing a Work Permit.
• The time to process the entire process is shortened to 10 working days instead of a total of 20 days as before.
2. Decentralization of processing authority (Article 4 of Decree 219/2025/ND-CP):
• Provincial People”s Committees are assigned the authority to directly grant, re-grant, renew and revoke Work Permit, as well as issue certificates of non-license of Work Permit.
3. Expanding the cases of exemption from work permits (Article 7 of Decree 219/2025/ND-CP):
• The new regulation clarifies and expands the subjects exempted from work permits, including foreign workers working less than 90 days in a year, foreigners working in the fields of finance, science, technology, innovation, national digital transformation, priority fields for socio-economic development, confirmed by ministries, ministerial-level agencies or provincial People”s Committees.
4. Regulations on expert positions no longer requiring 3 years of experience (Article 3 of Decree 219/2025/ND-CP):
• The Decree clearly stipulates that experts are people who: Have a university degree or higher and at least 2 years of relevant work experience; or Have a university degree and at least 1 year of experience if working in specific fields such as: science, technology, innovation, national digital transformation or priority areas for socio-economic development.
5. Flexibility when working in many localities (Clause 5, Article 22 of Decree 219/2025/ND-CP):
• Foreign workers granted a work permit in one province are still allowed to work in many different localities without having to update information.
6. Strengthening the connection of procedures through the National Public Service Portal (3, Article 6 of Decree 219/2025/ND-CP):
• The process of granting work permits and criminal records is carried out simultaneously on the National Public Service Portal
