14 cases of getting temporary residence card for foreigners in Vietnam

Law on amendments to a number of articles of law on entry, exit, transit and residence of foreigners in Vietnam of 2019 takes effect from July 1st, 2020.

I.There are 14 cases considered for getting temporary residence cards to foreigners in Vietnam:

1. NG3: Temporary residence card is issued to foreigners who are members of diplomatic missions, consular missions, representative offices of international organizations affiliated to United Nation, intergovernmental organizations in Vietnam and spouses, children under 18 years of age and helpers accompanying on missions.

2. LV1: Temporary residence card is issued to people who come to work with units affiliated to Vietnam’s Communist Party; the National Assembly, the government, Central Committee of Vietnamese Fatherland Front, the People’s Supreme Court, the People’s Supreme Procuracy, State Audit Agency, Ministries, ministerial agencies, Governmental agencies, the People’s Councils, the People’s Committees of provinces.

3. LV2: Temporary residence card issued  to foreigners who come to work with socio-political organizations, social organizations, Vietnam Chamber of Commerce and Industry.

4.LS: Temporary residence card issued  to foreign lawyers practicing in Vietnam.

5. DT1: Temporary residence card issued  to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam and contributing capital of VND 100 billion or more or investing in business lines benefitting from investment incentives, in administrative divisions benefitting from investment incentives decided by the Government.

6. DT2: Temporary residence card issued  to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam and contributing capital of VND 50 billion to less than VND 100 billion or investing in business lines benefitting from investment incentives treatment decided by the Government.

7. DT3: Temporary residence card issued  to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam and contributing capital of VND 3 billion to less than VND 50 billion.

8. NN1: Temporary residence card issued to foreigners who are the head of representative offices, projects of international organizations and foreign non-governmental organizations in Vietnam.

9. NN2: Temporary residence card issued to foreigners who are head of representative offices, branches of foreign businesses, representative offices of other foreign economic, cultural, professional organizations in Vietnam. .

10. DH: Temporary residence card issued to foreigners who come to study or serve internship.

11.PV1: Temporary residence card issued  to foreign correspondents and journalists  who have permanent residences in Vietnam.

12. LĐ1: Temporary residence card issued to foreigners working in Vietnam and certified of eligibility for work permit exemption, unless otherwise specified by international agreements to which Vietnam is a signatory.

13: LD2: Temporary residence card issued to foreigners working in Vietnam requiring work permit.

14 TT: Temporary residence card is issued to foreigners that are spouses or children under 18 years of age of foreigners issued with LV1, LV2, LS, DT1, DT2, DT3, NN1, NN2, DH, PV1, LD1 or LD2 visas or foreigners that are parents, spouses or children of Vietnamese citizens.

II. Validity of temporary resident card for foreigner in Vietnam.

1. Validity of issued temporary resident cards shall be at least 30 days shorter than remaining validity of passports.

2. Validity of DT1 temporary residence cards does not exceed 10 years.

3. Validity of NG3, LV1, LV2, LS, ĐT2 and DH temporary residence cards do not exceed 5 years.

4. Validity of NN1, NN2, ĐT3 and TT temporary residence cards do not exceed 3 years.

5. Validity of LĐ1, LĐ2 and PV1 temporary residence cards do not exceed 2 years.

6. An expired temporary resident card shall be considered for issuance anew.

Notes:
- Temporary residence card has a symbol similar to the visa symbol.
- For case of foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of less than 03 billion VND, it may be applied for a temporary residence card LĐ1 certified of eligibility for work permit exemption.
-The temporary residence card is valid for visa replacement.
