Personal papers not require consular legalization for use in Vietnam

 Vietnam Ministry of Justice has recently issued Official Letter No. 2421/HTQTCT-CT date 11 May 2015 temporary guiding some new provisions on notary - authentication of personal documents not require consular legalization for use in Vietnam as stipulated in Decree No. 23/2015/ND-CP during the period that issuance of Circular providing details if this Decree is still pending.

 Accordingly, for these types of documents issued by foreign authorities for individuals to use repeatedly, such as passport, permanent resident card, residence card, degrees, certificates, driving licenses ..., the authentication of copies from originals are not required consular legalization.

 This provision is a significant reform in the procedure of consular legalization of documents issued by foreign authorities for use in Vietnam.

    Could you tell me the procedure for authenticating my U.S.A. marriage certificate for use in applying for a work permit exemption in Vietnam? I will be working as an Australian volunteer in Vietnam. My husband will accompany me. I would like my husband to have a work permit exemption for the 18 months of my assignment. I am a dual USA/Australian and my husband is an Australian citizen. We were married in the USA. I have a State of Michigan Apostille/Exemplified copy of our marriage certificate with gold seal of the State of Michigan signed by the Secretary of State, Michigan. Will this be recognised by the Vietnamese government or do I need to send it to U.S. Department of State Authentications Office for the seal of the U.S. Department of State? or do I send it directly to the Vietnamese Embassy in Washington DC? Because both Vietnam and USA are State Members if the Hague Apostle Convention, will Vietnam accept my State of Michigan Marriage Apostle without U.S. Department of State seal?       Vietnam has not been a member of the Hague Apostle Convention, therefore, some documents issued in foreign county shall be legalized for use in Vietnam. If you have any inquiry, please contact with us via email ducphu.hoang@lawyervn.net.
