Opening the air tickets sales agencies for foreign airlines in Vietnam

I. Conditions for opening the air tickets sales agencies for foreign airlines in Vietnam.

Foreign airlines wish to conduct ticket sales in Vietnam through the air tickets sales agencies must satisfy the following conditions:

1. To be entitled to sell air tickets in Vietnam under an Aviation Treatment or an agreement between two Aviation Authorities approved by the Vietnamese Government;
2. Having a representative office of the foreign airlines in Vietnam located and operating in accordance with the law of Vietnam;
3. There is a staff of qualified ticket sales staff in the field of ticketing.

2. Procedures for granting licenses to open air tickets sales agencies for foreign airlines in Vietnam.

1. Foreign airlines wish to open a air tickets sales agencies must submit an application for grating a license to open a air ticket sales agency in Vietnam to the Vietnam Civil Aviation Agency.

The application for a license includes the following documents:
a. The application is made in standard form;
b. Document of the legal status and business operations of the foreign airline.
c. License for the establishment and operation of representative offices of foreign airlines in Vietnam;
d. Report on the investment capital and equipment of the air tickets sales agencies; Report on booking and reservation system in use;
e. Certificate of house ownership or land use right where the air tickets sales agencies located;
g. A report on ticket sales staff accompanied by certificates of graduation from the ticketing classes of Vietnamese or international civil aviation training institutions;
h. Resident card and working permit in Vietnam for the foreign staff of the air tickets sales agencies by the competent Vietnamese agencies;
I. Other documents required by the Civil Aviation Agency of Vietnam.
2. The Vietnam Civil Aviation Agency  shall consider and decide to grant licenses for opening the air tickets sales agencies for foreign airlines within 30 days after fully receiving the documents as mentioned above.
Foreign airlines must pay the fees in accordance with prevail regulations
3. After receiving the licenses, the air ticket sales agencies of the foreign airline must register its operation with the competent State agencies.
4. The Vietnam Civil Aviation Agency shall consider and decide to cancel or suspend the validity of the licenses for opening of air tickets sales agencies for foreign airlines in Vietnam in the following cases:
a. The Aviation Treatment expired, or the foreign airline is no longer the designated airline under the provisions of the Aviation Treatment, or
B. Agreement between two Aviation Authorities expired; or
c. Expiry of the time limit stated in the license; or
d. At the request of foreign airlines; or
e. The operation of a foreign airline or of a air tickets sales agencies breached an aviation treatment, an agreement between two aviation authorities, or the provisions of the law of Vietnam.

III. The rights and obligations of the air ticket sales agencies of the foreign airline in Vietnam.

1. The ticket-selling activities and reservations of the air tickets sales agencies of foreign airline must comply with the provisions of the aviation treatment and agreements between the two aviation authorities and the provisions of Vietnamese law. .

2. The hiring of working offices, residential houses, staff and facilities in service of tickets sales and daily life, the opening of accounts in foreign currencies and Vietnamese currency accounts at banks in Vietnam, the payment, transfer and transfer of foreign currency abroad, the import into Vietnam and the re-export of equipment necessary for the ticket sale activities of the air tickets sales agencies shall comply with the provisions of Vietnamese law and international treaties to which Vietnam is a party.
3. In cases where the licenses for opening of air tickets sales agencies in Vietnam for Foreign Airlines are revoked or suspended, the debt payment of the air tickets sales agencies with organizations and individuals involved in Vietnam shall comply with the provisions of Vietnamese law.
