Reporting requirement on the provision of cross-border advertising services in Vietnam

 

The provision of cross-border advertising services in Vietnam is defined as the act of foreign organizations and/or individuals ("Foreign Advertising Providers" or FRAP) using websites to conduct advertising services from device systems located outside of Vietnam, for users in Vietnam, and generating revenue from Vietnam

Websites conducting cross-border advertising services are defined as information systems using one or multiple websites in the forms of symbols, numbers, characters, images, sounds, and other forms of information with the purpose of providing to network users the services of storing; providing; using; searching; exchanging; and sharing information, images, and sounds; creating forums; and online chatting to provide advertising services

Foreign Advertising Providers providing cross-border advertising services in Vietnam are obliged to notify the Ministry of Information and Communications of  Vietnam the following information:

- Organization name, transaction name, head office address where advertising service provision activities are registered; the location of the main server system providing the service and the server system located in Vietnam (if any);
- Contact point: name of representative organization or individual in Vietnam (if any), email address, contact phone;

Form and time of notification: 15 days before starting the business of cross-border advertising services in Vietnam, Foreign Advertising Providers send notices directly, or by post, or by other means of communication. electronic media to the Ministry of Information and Communications of Vietnam (Department of Radio, Television and Electronic Information);

When receiving the notice, the receiving body shall send a written confirmation or via electronic means to the organization or enterprise within 07 working days from the date of receipt of the notice;

Onshore advertisement publishers and advertisers that cooperate with Foreign Advertising Providers providing cross-border advertising services in Vietnam shall make annual reports (before December 31) or make ad-hoc reports upon request on the provision of cross-border advertising services in Vietnam to the Ministry of Information and Communications of Vietnam (Department of Radio, Television and Electronic Information) according to Form No. 01 issued together with Decree 70/2021/ND-CP dated July 20, 2021 of the Government of Vietnam.

Reports are sent in one of the following means: sending reports in person, by post or by electronic means.

The report includes the following:

1. Name of organization or enterprise:

3. Head office address, phone number, email address:
4. List of Foreign Advertising Providers with cross-border advertising cooperation in Vietnam:
5. Revenue from cross-border cooperation in advertising in Vietnam (from January 1 to the reporting time):
6. Problems arising (if any):
7. Proposals and suggestions (if any):
